Limitation of Liability
By using the services of Kumar's PolyClinic and/or the KumarCare+ platform, you expressly agree to the following terms of limitation of liability, which are designed to protect all stakeholders while ensuring a balanced approach to risk mitigation. These provisions apply to the maximum extent permissible:
- Appointment Rescheduling and Cancellations
Medical professionals at Kumar's PolyClinic may encounter emergencies that require immediate attention, potentially resulting in the rescheduling or cancellation of scheduled appointments depending on availability. While we strive to notify patients of these changes, we cannot guarantee that notifications will always be delivered. Patients are strongly encouraged to regularly check the appointment section after logging into their KumarCare+ account for the most up-to-date information. The Clinic will make reasonable efforts to update appointment statuses in the system, but assumes no liability for any inconvenience, costs, or consequences arising from such rescheduling or cancellations.
- Comprehensive Exclusion of Damages

- Medical Advice and Outcomes Disclaimer
The Clinic Parties are not responsible for any adverse outcomes or results from medical treatments, procedures, or advice provided through the Clinic or its affiliated healthcare professionals. The provision of medical care inherently involves risks, and outcomes may vary based on individual circumstances.

The Clinic Parties shall not be held liable for any interruptions, delays, inaccuracies, or failures in the KumarCare+ platform due to technological issues, server outages, software bugs, or unauthorized third-party intrusions, including hacking or other cybersecurity breaches.
- Third-Party Services
Any services or products procured through third-party vendors or affiliates, including but not limited to payment processors, insurance providers, diagnostic labs, pharmacy services, etc, are provided "as is." The Clinic Parties disclaim all liability for any errors, omissions, or issues arising from such third-party services. The Clinic Parties are not responsible for any actions, errors, or omissions by any third-party vendors. Any dispute with a third party is solely between the user and that vendor, and the Clinic shall bear no liability whatsoever.
- Force Majeure Events
The Clinic Parties shall not be liable for any failure or delay in the performance of their obligations due to events beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemics, governmental actions, labor disputes, cyberattacks, or any other events classified as force majeure.

You agree to indemnify, defend, and hold harmless the Clinic Parties from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the services, breach of this Privacy Policy, or violation of applicable laws.
